At Kunktela Limited, we are committed to supplying food-grade nitrous oxide responsibly and in full accordance with UK legislation. We understand our obligations as a supplier of regulated products and have implemented compliance procedures to help ensure our products are sold only for lawful commercial and culinary purposes.

As of 8 November 2023, nitrous oxide is classified as a Class C controlled drug under the Misuse of Drugs Act 1971 and placed in Schedule 5 of the Misuse of Drugs Regulations 2001.

This change means that, although nitrous oxide continues to be available for legitimate commercial, catering and food production uses, both suppliers and purchasers must ensure that it is obtained and used only for lawful purposes and not for recreational inhalation ("getting high"). 

Purchasing food-grade nitrous oxide for genuine hospitality, catering and commercial food preparation remains lawful.

However, customers are responsible for ensuring that products are used only for legitimate business purposes. By placing an order with Kunktela, you confirm that your purchase is intended solely for lawful culinary or commercial use.

Both suppliers and customers have a legal responsibility to exercise reasonable care when purchasing and supplying nitrous oxide.

Kunktela operates responsible supply procedures to help ensure compliance with UK legislation. We may request additional information where necessary before processing an order.

These checks help us protect our customers, our business and the wider hospitality industry.

Under current UK legislation:

• Possession of nitrous oxide for wrongful inhalation may result in criminal prosecution. 
• Supplying nitrous oxide where it is intended for recreational misuse is a serious criminal offence. 
• Businesses that knowingly or recklessly supply products for unlawful purposes may face significant legal penalties. 

Food-grade nitrous oxide remains available for genuine catering and commercial applications.

At present, businesses purchasing nitrous oxide for lawful culinary use do not require a special licence. However, suppliers are expected to carry out appropriate due diligence where necessary. 

Depending on the order, Kunktela may request:

• Proof of age (18+) 
• Company or trading details 
• Delivery address verification 
• Intended use confirmation 
• Additional identification where appropriate 

Failure to provide satisfactory information may result in an order being delayed, cancelled or refused.

As part of our compliance programme, we carefully review orders that may present an increased risk.

Examples include:

• unusually large quantities; 
• delivery addresses with no clear commercial purpose; 
• inconsistent customer information; or 
• purchases where the intended use cannot be verified. 

Where necessary, we reserve the right to refuse supply.
